Recently, Yu Wenqing, the exclusive right owner of the figurative mark "羊羊羊 (Chinese character for goat)", sued Hengyuanxiang Group before Beijing No.2 Intermediate People's Court and claimed a compensation of over 10 million RMB. Additionally, YU wenqing reported the case to local administrations for industry and commerce in Beijing, Jiangsu and other provinces.
Yu Wenqing claimed that, in 2001, he filed application in class 25 for registration of the word "羊" covering goods of knitting garments, shoes, hats, etc. The mark was approved in 2003.
In August 2009, Yu found that Hengyuanxiang Group put the said trademark on their T shirts and other kinds of garments without his permission. Hengyuanxiang Group neverthelessd made a counterclaim against Yu for copyright infringement. Hengyuanxiang Group said that the trademark logo was created in 1997 by itself and registered copyright in November 2002. Therefore, Yu's registration for "羊羊羊" trademark infringed its copyright in bad faith. Hengyuanxiang Group claimed for 4,000 RMB and public apology.
