With the implementation of the revised Chinese patent law in 2009 and implementing regulations for the patent law in 2010, the revision of the Examination Guideline for Patent was approved and became effective as of February 1, 2010.
The Examination Guideline for Patent provide for detailed rules to be followed in the prosecution, grant, reexamination and invalidation of patents. The revision was to comply with the Patent Law and the Implementing Regulations of Patent Law. In addition, some standards were also adjusted in order to improve the efficiency of patent examination and grant and to regulate the activities relating to the patent applications and examination.
The revision of the Examination Guideline for Patent started more than one year ago. Several rounds of discussions and workshop had been done to complete the final version of the guidelines.
