Recently, Kappa (Shanghai) Sports Co., Ltd., (hereinafter referred to as Kappa) brought a case of trademark infringement before Beijing 2nd Intermediate People’s Court against 2 Beijing local companies: BeiJing Jingtailong Trade Co., Ltd and Beijing Tianchao Warehouse Supermarket Co., Ltd.
Kappa is the owner of the registered trademark “Kappa”, both in words and devices and enjoys an exclusive right of use across China. In april of 2009, kappa found sale of Kappa products and purchased the products in Jingtailong Shopping center and Tiankelong Supermarket. After review of the product, Kappa confirmed that the sold products were counterfeited. .
Kappa claimed that it is a world famous sports brand, and enjoys a high reputation among the similar products. Due to the sale of the counterfeit products, kappa suffered huge economic losses, and a negative impact on their brand has been produced. Therefore, Kappa requested the court to order the two defendants to stop selling the infringing goods immediately and pay a compensation of 300,000 Renminbi yuan.
