Two new guidelines for IP assets appraisal started to be implemented in July, one is Standards for the Appraisal of Assets--Intangible Assets and the other is the Guiding Opinions on Appraisal of Patent Assets. The two guidelines, formulated by China Appraisal Society (CAS), are said to be of importance in regulating the appraisal of intangible assets such as patent and in promoting the financing by means of IP pledge.
The Standards for the Appraisal of Assets-Intangible Assets defines the scope of intangible assets, which include patent rights, trademark rights, copyright rights, know-how, sales network, clients relationship, franchise rights, contract. It also includes commercial reputation. The standards required certified asset appraisers to appropriately choose one or more applicable asset appraisal means listed in the standards. Before using the means, factors such as purpose, target, materials should be considered.
In accordance with the Standards for the Appraisal of Assets—Intangible Assets, Guiding Opinions on Appraisal of Patent Assets defines that the objects of patent asset appraisal refer to the ownership and use of patent, it also makes a clear definition for how to appraise and how to disclose.
