In order to strengthen the administration and promote the healthy development of the reproduction industry, General Administration of Press and Publication (GAPP) in China recently formulated Measures for Administration of Reproduction(hereinafter 2009 Measures), which will be implemented on August 1, 2009. Accordingly the Measures for Administration of Reproduction of Audio-visual Products, which were published by GAPP on February 1, 1996, were abolished.
The 2009 Measures was the result of the integrity and unity of reproduction sector, especially the reproduction of computer software and the rapid development of recordable CDs. The reproduction sector is therefore required to be supervised. The 2009 Measures re-classified the reproduction activities and provided for the definition, establilshment of the reproduction units, management of the reproduction business activities, legal liabilities, etc.
The 2009 Measures define "Reproduction Business Activity"; make clear the conditions for establishing reproduction units and modify the jurisdictions and procedures of approval; identify management requirements of reproduction manufacturing equipments; strengthen the supervision and administration of reproduction business activity; and perfect relevant legal responsibilities by black list. Further, where the meansures are not complies, it may happen that the licenses will be removed.
