In June, Sichuan Baijia Food Company (hereinafter called Baijia Food), one of the largest instant noodle manufacturers in China, filed a lawsuit against OKAI Import and Export GmbH with the Munich District Court in Germany, asking the court to cancel OKAI's trademark application for 白家(Baijia) and return the trademark to Baijia.
OKAI, a Germany-based department store run by a Chinese-German, is said to be a distributor for Chinese food manufacturers including 白家(Baijia) and 王致和(Wangzhihe). Two and half years ago, OKAI had preemptively registered the trademark of白家(Baijia) in the European Union.
Due to failure in discussing with OKAI, Baijia Food decided to use the legal weapon to safeguard its trademark. It is learned that Baijia Food is using the legal team that helped Wangzhihe in Germany.
It is also learned that OKAI has preemptively registered several other trademarks of Chinese food manufacturers including Laoganma and Qiaqia. Currently, Baijia Food is consulting with other Chinese companies to make a joint efforts against OKAI.
