On the afternoon of May 19, 2025, local time in San Diego, USA, Christopher SHEN, a senior partner of NTD Intellectual Property Attorneys (NTD), was invited to participate in the "Chinese Case Law" seminar of the China-themed series of events at the INTA 2025 Annual Meeting. He participated in the discussion and delivered a thematic speech on the theme of "Damage Base Calculation & Exploration of Criminal Incidental Civil Litigation".
This seminar was moderated by Fang He, a partner of King & Wood Mallesons. Together with several other Chinese trademark law experts, Helen Xia from Hogan Lovells, Hui Huang from Wanhuida Intellectual Property and Carol Wang from Lusheng Law Firm, Mr. Shen shared and interpreted the characteristics presented by the latest cases:
1. stricter review standards for absolute-ground examinations and requirements for trademark use intentions;
2. enhanced protection for well-known trademarks, the current situation of trademark co-existence agreements, and the expansion of the scope of protection for prior rights;
3. the legal application of malicious factors in the protection of well-known trademarks, trade dress, as well as in rights conflicts and trademark squatting;
4. the legitimate use of descriptive terms and the act of scratching codes in the context of exhaustion of rights;
5. stringent application of the calculation methods for damage compensation basis, and continuous exploration of the scope of compensation in criminal incidental civil litigation.
Christopher Shen, NTD Senior Partner, Attorney-at-Law and Trademark Attorney. Christopher Shen joined NTD after graduating from Renmin University of China in 1998 and started his profession in intellectual property. Afterwards, Mr. Shen received advanced education in the United States and earned a LL.M. degree in Intellectual Property Law from the George Washington University Law School. Mr. Shen has been qualified to practice law in both China and New York State since 2000 and 2005 respectively.
Mr. Shen concentrates his practice in IP strategy counseling, foreign-related IP litigation and administrative enforcement. Mr. Shen has nearly 30 years of experience in representing many famous domestic and foreign companies in lawsuits and arbitrations with respect to patent, trademark, copyright and unfair competition disputes.
