Recently, Danfoss A/S prevailed in a first instance case against a refrigeration equipment company in Zhejiang province. The Beijing 1st Intermediate People’s Court was ordered to stop the infringement and pay a damage of 200,000 Renminbi yuan.
Danfoss A/S is a Denmark-based company and an international leading manufacturer in refrigeration, air-conditioning, heating and water-control. They started to market their products bearing the trademark Danfoss in China in the 1990s and in 2007, they found that refrigeration expansion valves were sold in the Chinese market bearing the mark Danfoss. Investigation indicated that the products were manufactured and sold by a Zhejiang company. In December 2008, Danfoss filed a case to the Beijing No.1 Intermediate People's Court.
In April of 2009, Beijing No.1 Intermediate People's Court ruled that the Zhejiang company infringed Danfoss’s trademark rights by using the mark in their products. Therefore, the decision was made in favor of Danfoss.
