Recently, the draft amendment of "Implementation Regulations of Patent Law of People's Republic of China" was submitted to the State Council for review.
The draft amendment include the following aspects: patent application documents; patent application and examination and approval procedures; evaluation report and invalidation procedure; simplification of fees and procedures; compulsory licensing; utilization of patent and rewards to inventors; patent protection and international application entering the national phase.
In accordance with the relevant provisions of the Legislation Law, the State Council will solicit public opinions by means of seminars, discussions, workshops, etc. The Legislative Affairs Office of the State Council will be responsible to make further revisions on the basis of the solicited comments or suggestions. Upon completion, the draft will be submitted to the Executive Meeting of the State Council for approval.
