Recently, the Patent Reexamination Board of State Intellectual Property Office revised the Measures on the Examination Timelines of Patent Invalidation Cases (Trial). According to the measures, the average examination period of invalidation cases is expected to be limited within 6 months. Few countries in the world can complete the invalidation case in 6 months.
The measures were a result of concerned party’s voice that sufficient time should be given in the examination of invalidation cases and efficiency should be improved. To achieve this goal, the Patent Reexamination Board made an in-depth study on the original trial measures and has made the revision as to the timelines which will shorten the internal procedures and extend the time limits for concerned parties in submitting the response.
