    Panasonic Enforces Trademark in Fujian Province

    Recently, a case relating the exclusive use of registered trademark “National” was settled between Panasonic Corporation (hereinafter Panasonic, the plaintiff) and Fu'an Dacheng Electric Company (hereinafter called Dacheng) in Fujian province. The case was brought to Fuzhou Intermediate People’s court.

     

    Panasonic first learnt from Fuzhou Customs in March 2008 that Dacheng used the representation “Inter National” on its exported water pumps and packages. The use of Inter National was suspected of infringing Panasonic's registered trademark recorded at the General Administration of Customs.  Further investigation indicated that, in addition to the mark “Inter National”, Dacheng also used the mark “National” on its products. Panasonic then sought for injunction and 300,000 Renminbi yuan in damages.  In July the same year, Dacheng requested the Trademark Office under the State Administration for Industry and Commerce to cancel the trademark “National” on the ground of non-use by Panasonic for more than three years. 

     

    Upon mediation by the court, Dacheng admitted its infringement by using “Inter National”, and promised that they will not use marks identical or similar to “National” . Dacheng also withdrew its request for cancelation before Chinese Trademark Office and agreed to pay a damage of 20,000 RMB yuan.
