Recently, Beijing No.2 Intermediate People's Court concluded the case relating to Harley-Davidson trademark. In its decision, the court ruled that Beijing Halei Trading Center should be liable for unauthorized use of the registered trademark Harley-Davidson and the use of word 哈雷(transliteration of Harley) constitutes unfair competition for not complying with the principle of honesty and credibility.
The case was brought to the court in June 2007 by Harley-Davidson Motor Co. In addition to Beijing Halei Trading Center, Beijing Hanma and Halei Store was also brought to the court as co-defendant.
At present, the case is being appealed to the higher court.
