In a recent decision on trademark infringement involving a UK Firm, Cummings Turbo Technologies Inc.,(hereinafter called Cummings), Wuxi (Jiangsu) Intermediate People's Court enjoined the defendant, Jiangsu Tongtai Turbo Factory (hereafter referred to as Tongtai) from manufacturing and distributing products bearing the registered marks owned by Cummings and 80,000 yuan Renminbi in damages was awarded to Cummings.
Cummings is the owner of the marks, 'Breathing Life into the Machine" and "Holset". In 2006, they found Tongtai, co-owned by Yang and Sun, was engaged in trademark infringement and then brought the case to the court. After the review, the court found that Tongtai was using the marks ‘Breathing Life into the Machine" and "Holset".in their products and was selling the products. Tongtai infringed the exclusive rights of Cummings by using the marks on their products. The Court therefore rendered the above decision.
