Recently, State Intellectual Property Office (SIPO) issued the working outlines in 2009. According to the outlines, SIPO will focus on the following tasks: implementing IP strategy, coordinating IP, improving the patent regulations and rules, strengthening the macro-management of IP, training the patent examiners, etc.
In terms of the coordination, SIPO will fully exert its role in the ministerial joint meeting system on national IP strategy implementation and will promote the IP strategy implementation in industries. Compass Plan will be developed in some export-oriented industries to help them in IP creation, application, protection and management. Guidance will be provided to the establishment and implementation of local and regional IP strategies.
With regard to law and regulations, SIPO will work with Legislative Affairs Office of the State Council in revising the implementing regulations of patent law. At the same time, SIPO will revise and formulate relevant regulations including examination guidelines, measures for patent administrative law enforcement and measures for the compulsory licensing for patent, standards in determining infringement, in order to implement the revised patent law.
Additionally, SIPO will deepen the IP cooperation and consultation mechanism and will define the conditions, procedure and contents of the cooperation and consultation mechanism between SIPO and local governments. Guidance will be provided to cities in establishing the IP pilot project.. Report mechanism shall be established to provide the working statistics in IP. Efforts will be further strengthened in enforcement campaign such as”Thunderstorm" and "Skynet". Cases of significant influence, aid in maintaining the IP rights and complaint service in IP will all be further developed.
Internally, SIPO will further improve the examination, information infrastructure, dissemination of information, training of personnel and international cooperation.
