    China's First Anti-monopoly Tribunal Established in Shanghai

    Recently, the first special tribunal for anti-monopoly cases was established in Shanghai 2nd Intermediate People's Court. Both civil and administrative cases related to anti-monopoly will be handled the tribunal.

     

    Civil cases of anti-monopoly include monopoly agreement, abuse of dominant position in the market, market concentration that excludes or restricts competition, abuse of IPR, litigation the purpose of which is to exclude or restrict competition.  Administrative cases refer to the acts by the administrative agencies in handling the monopoly agreement, abuse of dominant position in the market, market concentration and other related acts. The establishment of the tribunal is expected to bring into unity the application of laws and to improve the trial efficiency.
