According to the 2016 report on patent survey data by SIPO, there was a continuous and growing demand for patent protection, a steady rise in effective patent implementation rate and a high industrialization degree of enterprise patents. In comparison, small and micro businesses were confronting with difficulties including high risk of infringement, protection of legal right and commercialization of patented technologies.
In 2016, there were 48,916 patent enforcement cases, an increase of 36.5%, as compared with the same period of the previous year. The difficulty in providing evidence has become the most important restricting factor in patent judicial protection.
