Recently, the Supreme People’s Court issued 10 guiding cases, all concerning intellectual property right, which include 9 civil cases and 1 criminal case.
These guiding cases mainly relate to anti-monopoly and infringements of copyright, trademark, patent right, new plant varieties. These cases, with great social influence, were selected from the exemplary cases by the Supreme People’s Court and local courts.
This is the first time that the Supreme People’s Court released guiding cases focusing on one specialized field. These cases help to further enhance intellectual property trial and to implement the national intellectual property strategy and the innovation-driven development strategy. It is also a new exploration in strengthening trial guidance, unifying criterion in applicable laws and improving the case guidance mechanism.
