    Law on Network Security was passed to protect IP related to internet technology

    Recently, the Law on Network Security of People’s Republic of China, which will come into effect on June 1st, 2017, was approved by the Standing Committee of the National People’s Congress. This is the basic law in internet to enhance the protection of personal information against cyber fraud.

    According to the Law on Network Security, the State Council, governments of provinces, autonomous regions and municipalities should make overall plans to increase investment in key industries and projects of internet technologies, support the research, development and utilization of security technologies and encourage the participation of enterprises, research institutes and universities in national innovation projects for network security technologies.

    In terms of private information leakage, it is ruled that the provider for a certain network product or service that collects user’s information should explicitly instruct and obtain the consent of the user, and an internet operator may not leak, tamper or damage the collected information. It is further ruled that any individual or organization may not steal or acquire personal information in other illegal ways, or illegally sell or provide personal information to others, and the corresponding legal responsibility for the behaviors above is also prescribed.
