Recently, Opinions on Improving Property Rights Protection System to Protect Property Rights (hereinafter the opinions) were issued. Clarification is made in 11 aspects to improve the protection for properties. The issuance of the opinions is vital to the motivation of innovation and entrepreneurship and the realization of social justice and sustainable and sound development of economy and society.
It is also noted that the rules of the property law must be abided—all personal properties legally acquired should be protected and should not be illegally violated or deprived without due process of law; the judicial practice and enforcement activities should be in accordance with the principle of contractual freedom.
The opinions also define that the intellectual property should be fully protected due to its key role of competition in the modern society. Not only should efforts be made against the infringements, but the punitive damages system should be set for a full protection of the exclusive rights of the IP owners.
