    SIPO set up National Center for Patent Enforcement Management for E-commerce in Zhejiang

    At a recent conference, SIPO set up the National Center for Patent Enforcement Management for E-commerce in Zhejiang (hereinafter the Center), which is the first center for management of patent enforcement for e-commerce in China.

    With the establishment of the center, SIPO creates a cooperative mechanism between the e-commerce platforms in Zhejiang and the enforcement agencies for intellectual property across China, which can efficiently overcome the difficulty of cross-provincial enforcement of patent infringement in e-commerce.

    It is said that the efficiency of e-commerce patent enforcement will be significantly increased. The center will receive reports and complaints for patent infringement in e-commerce in Zhejiang, which will then be distributed to related intellectual property aid centers. These aid centers are responsible for issuing quick advisory opinions. For e-commerce cases, the local IP Offices are required to provide rapid assistance upon receiving notice for assisting the execution.  With regard to mass patent infringement cases and cases with tremendous social impacts, SIPO will take the role of coordination for handling. In terms of patent infringement and counterfeit cases that are verified online, the Center will confirm the detailed information of the respondent via e-commerce platform operator. Then, the cases will be transferred without delay to local intellectual property office that has jurisdiction over the case.
