Recently, SIPO issued the Guidelines on Patent Administrative Enforcement (Trial) (hereinafter as the Guidelines) which defines the requirement for patent enforcement and case handling.
It is reported that the amended Guidelines includes main body and forms. Compared to the original version, the new version was amended in the following aspect: introduction of a new chapter entitled “Handling patent infringement disputes at exhibition and in e-commerce”; rewriting of the chapter on enforcement administration; attachment of the forms related to enforcement; adjustment and improvement of the functions relating to handling patent infringement disputes, confiscating patent counterfeits and conciliating other patent disputes.
The Guidelines after amendment further conform to legal provisions and is an important measure for strict administrative protection of patent.
