    Black and white listing system is to be established for internet literature copyright administration

    At a recent workshop, National Copyright Administration of China (hereinafter NCAC) released Notification on Enhancing the Copyright Management of Internet Literature (draft for comments) (hereinafter the Notification), in which, article 10 clearly puts forward that NCAC will establish the black and white listing system by publishing the black list of network service providers of pirated works, and the white list of network literature works under supervision.

    It is ruled that network service provider shall not provide unauthorized literature works or in any disguised forms. Network service provider shall not facilitate the dissemination of infringing works. Network service provider that provides search link service shall not disseminate infringements through directional search links, deep links, etc. Network service provider that provides information storage service shall audit related information to affirm that literature works are provided by the owner or with permission of the owner. Cloud storage provider shall abide by the Notification on Regulating Cloud Storage Service Copyright by actively shielding and deleting infringing works.

    In 2014, there were 4.32 billion Yuan loss in pay-to-view service at PC end, 3.45 billion Yuan loss at mobile terminal, and 2.18 billion Yuan loss in derivative products, according to the White Paper of Copyright Protection for Internet Literature released by iResearch at the beginning of 2016.
