Recently, General Office of the State Council issued 2016 working points for fight against intellectual property infringement and sale of counterfeits (hereinafter the working points ) which cover 27 key points in 7 aspects.
According to the working points, the administration will be strengthened against the infringing and counterfeit acts on internet by fighting against the sale of fake and shoddy products. Public campaigns will be carried out in key fields of food and drug, agricultural material, household appliances, etc. China will also enhance the supervision of key manufacturing enterprises and specialized markets, as well as the intellectual property right of foreign related exhibitions and trade fairs. Efforts will be continued to ensure the use of legitimate software in government and enterprises. Trademark squatting will be seriously investigated and handled.
Further, the connection between administrative enforcement and criminal jurisdiction will be coordinated to maintain and operate the information sharing system relating to infringement and counterfeit acts. Meanwhile, cooperation among departments and regions will be improved through clue reporting, evidence transferring and cooperative investigation system.
It is noted that the judicial protection of intellectual property will be improved on the basis of the reform of combing civil, administrative and criminal case of IP cases, as already done in Beijing, Shanghai and Guangzhou.
