Recently, the Supreme People’s Procuratorate (hereinafter SPP) issued 10 Important Cases concerning the protection of intellectual property by procuratorial authorities in 2015, including trade secret violation, copyright infringement, counterfeit trademark, dispute of trademark use and patent right infringement. According to the statistics from SPP, in 2015, SPP approved the arrest of 4,445 suspects liable for 2,615 criminal cases concerning intellectual property infringement, and instituted public prosecution against 8025 suspects out of 4,484 cases.
It is reported that administrations for industry & commerce and authorities for market supervision across China investigated 51,000 infringing and counterfeit cases, involving 740,000,000 Yuan. In terms of abuse-of-power crimes, 3 suspects of 3 cases were approved for arrest for giving free rein to producing and selling of fake commodities, and 3 suspects of 3 cases were prosecuted; 15 suspects of 13 cases were approved for arrest for crime of irregularities for non-transferring criminal cases, 118 suspects of 64 cases were prosecuted by the procuratorial organizations. In terms of supervision of criminal litigation, 717 cases were filed and 859 suspects were investigated for producing and selling fake commodities, 49 cases were filed and 61 suspects were investigated for infringing intellectual property rights.
