At a recent conference, the report on judicial protection of intellectual property rights in 2015 was formally released by the Supreme People’s Court.
In 2015, all courts across China accepted a total of 130,200 intellectual property related first instance cases and 101,324 intellectual property related first instance cases were concluded. Among these cases, there were 109,386 new civil cases, 9839 new administrative cases, and 10,975 new criminal cases.
It is also reported that, by the end of 2015, there are 6 higher courts, 95 intermediate courts and 104 preliminary courts that have carried out the reform of combining civil, criminal and administrative adjudications into one court. And in 2016 this combination will be further promoted for the efficiency of trial of IP related cases.
With regard to the IP courts in Beijing, Shanghai and Guangzhou, systems will be established so that the presiding judge should be responsible and evaluation system should be based on the performance.
