Recently, the Draft Guidelines for Regulating Abuse of Intellectual Property and Anti-Monopoly (hereinafter the Draft Guidelines) was formulated by National Development and Reform Commission (hereinafter NDRC) and started to solicit public opinions.
According to the Anti-Monopoly Law of People’s Republic of China, the Anti-Monopoly Bureau under the State Council is in charge of formulating Anti-Monopoly Guidelines. NDRC thus took an active role in advancing the work to further regulate the enforcement against monopoly by defining the guiding rules relating to anti-monopoly system, providing a clear and rational expectation for the market and improving the enforcement transparency.
It is said that NDRC is also working on other guidelines concerning the monopoly such as automobile industry, guidelines for exemption procedure of monopoly agreement, etc.
