    China improves the reward system for scientific researchers

    According to the official from Ministry of Science and Technology, the Newly Revised Law of the PRC on Promoting the Transformation of Scientific and Technological Achievements (hereinafter the New Transformation Law) perfected and solved the widely concerned issue of reward system for scientific researchers.

    Pursuant to the New Transformation Law, where there is an agreement, the concerned parties should follow. It is also clearly defined that where there is no such agreement or regulations, the reward given to scientific researchers should be no less than 50% of the net income. Where the reward is less than 50% when there is no agreement, it will be considered to be of no effect by law. Meanwhile, the New Transformation Law further specified that the reward of scientific and technological achievements is not limited to the fixed total sum of wages of the entity.

    Other revisions were also made to taking into account of the coordination with the relevant provisions of the Patent Law, the Law of the P.R.China on Employment Contract and other related laws and regulations.
