Recently，SIPO approved the decision on revising the Administrative Measures for Patent Enforcement (hereinafter the measures), which will come into effect from July 1, 2015.
The revision was to meet the demand of emerging issues due to the technological progress such as e-commerce. A national check on administrative enforcement of patent by the National People’s Congress further required that enhanced efforts should be made towards the patent protection.
Under the measures, where the administrative agencies find infringement during the exhibition, the exhibitor should remove the exhibited products, destroy the relevant promotion materials, and replace the exhibiting board. In case of the infringement in e-commerce, the service providers for such e–commerce should delete, remove or disconnect the pages displaying the infringement products. The newly revised measures also provide for specified time limit for action initiated by the administrative agencies.
