    China starts to solicit public opinion for the 4th amendment of the Patent Law

    China currently started the work of further amendment of the patent law in order to further improve and encourage the innovation and create a more favorable environment for intellectual property protection. The preparatory work began in 2011 to meet the criteria established in the Opinions of Combating the Intellectual Property Infringement and Manufacture of Sale of Counterfeit and Fake Commodities. The opinions were issued by the State Council after the special campaign against the IP infringement and manufacture and sale of counterfeit products. By the end of 2012, some special amendment was finally completed and was submitted to the State Council in 2013. On the basis of the feedback from the National Legislative Congress, the SIPO formally launched the 4th amendment of the Chinese Patent Law in 2014.

    Now the public can review the draft amendment by getting access to SIPO website http://www.sipo.gov.cn/ztzl/ywzt/zlfjqssxzdscxg/ and submit any written comment to the Legal Affairs Department by patentlaw@sipo.gov.cn or by fax 62083681. The deadline is April 28, 2015.
