Recently, the State Intellectual Property Office of China (SIPO) has started soliciting public opinions on the Draft Amendments to Administrative Enforcement Relating to Pass-off of Patents (hereinafter as the “Draft Amendments”).
According to SIPO, the Draft Amendments focus more on the improvement of patent administration enforcement construction, and will intensify the management of the administration team as well as the implementation of the enforcement accountability of related authorities. The Draft Amendments emphasize that the patent administration authorities should strengthen the administration enforcement power in the e-commerce field and improve the efficiency in handling online patent infringement disputes and investigating and disposing the pass-off of patents; the authorities should notify the e-commerce platforms to delete or block the websites timely which are involved in selling counterfeiting goods.
