After the establishment of Beijing and Guangzhou IP Court, Shanghai IP Court was recently established. Unlike the other two Shanghai IP Court is collocated and cooperates with the Third Intermediate People's Court of Shanghai.
Shanghai IP Court will be in charge of the following cases:
1．civil and administrative cases of the first instance related to protection of patents, new plant varieties, integrated circuit layout designs, technical secrets, computer software etc.;
2．appeals against the first instance administrative decisions by people's governments at or above the county level in Shanghai, involving copyrights, trademarks and unfair competition etc.;
3．first instance IP cases involving the recognition of well-known trademarks;
4．first instance anti-trust cases;
5．appeals against the first instance administrative cases handled by basic–level People’s courts in Shanghai, involving copyrights, trademarks, technical contracts, unfair competition and other intellectual property rights;
6．other civil and administrative IP cases that shall be governed by Shanghai IP court under the relevant law.
Shanghai IP Court is independent in hearing cases though sharing the same location with Third Intermediate People's court of Shanghai.
