    Key Work points on combatting IP infringement in 2014 released by the State Council

    In order to establish a long mechanism for IP protection and create a legalized business environment, the General Office of the State Council issued the Key Work Arrangement for Crackdowns on Intellectual Property Infringement and the Production and Sale of Counterfeit Goods in 2014.

    The Arrangements specify details in the following aspects.

    1. Special operation will be taken on outstanding issues, such as crackdown on deceptive online advertising, counterfeit products selling and copyright piracy, eliminating illegal video and audio websites, and reinforcing supervision and management on internet service providers, domain name registration and information services. Specific campaign against inferior gasoline and diesel oil trading will be conducted and typical trade secret infringement cases will be released to strengthen trade secret protection.

    2. Special operation will be taken in key areas, including infringement of agricultural products and drugs, trademarks, copyrights, patent rights and rights of new plant varieties, geographical indications, integrated circuit layout designs and Chinese traditional brands; and customs protection of IP rights will be further strengthened.

    3. Judicial protection will be intensified to eradicate chain crimes and crime networks by cooperative law enforcement efforts, and administration of justice will be improved in key industries and areas to avoid repeated offenses.

    4. Laws and regulations of IPR protection should be further revised, including Copyright Law, Patent Law, Seed Law, Trademark Law Implementing Regulations and Regulations on Patent Commissioning. The disclosure system for administrative punitive cases should be promoted to blacklist those enterprises and individuals violating the laws and regulations of IP.
