In spite of the patent law implementation for 30 years and the significant increase of patent applications in China, the core innovative ability and the investment in R & D are still low. The social environment for IP protection is not fully formed. It is under this situation that the legislative body of China, the Standing Committee of the National People's Congress (NPC), recently launched a round of inspection on Patent Law enforcement nationwide.
The purpose is to further improve the IP protection environment and encourage innovation. The inspection mainly focuses on the application, utilization and protection of patents and patent rights. The inspection will be conducted in different provinces. In addition to the judicial and administrative enforcement agencies, enterprises, academic institutions and scientific research institutions will be also inspected to further strengthen the patent application, creation and utilization and patent rights protection.
Since 1984 when the Patent Law came into force, this is the second inspection after 2006.
