    China’s Copyright Law Amended to strengthen enforcement

    After soliciting public comments, the copyright law is yet to be published. According to the National Copyright Administration of China (NCAC), the amendment is said to be comprehensive and cover a wide range of protection.

    Under the current amendment, protection is to be further strengthened for rightholders. Measures include newly-added administrative enforcement measures, choice by the rightholder in terms of damages, increasing of statutory damages, punitive damages, assumption of fault by infringers, improvement of technical protection measures and administration information for rights.

    It is learnt that this copyright law amendment has triggered heated discussion among members of the public from domestic and also drew wide attention from trade organizations and businesses from abroad. The Chinese government made a signal that more efforts will be made to fight against piracy, lower the threshold for IP crimes and enhance the IP protection.
