    The fines for trademark infringement will be increased in China

    It is learnt from 2012 China Trademark Annual Meeting that China will increase the penalties for trademark infringement from 500,000 Renminbi yuan to 1 million Renminbi yuan. This was already reflected in the third amendment of trademark law in China.

    According to the amendment, the act of unauthorized use of another's trademark as the company name or product name, or assisting others to commit trademark infringement are expected to be considered as acts of trademark infringement. The maximum damages for trademark infringement is expected to be raised from 500,000 Renminbi yuan to 1 million Renminbi yuan. The punishment for repetitive infringement shall be severely increased.  The amendment is to reduce the burden of proof by the person being infringed. If necessary, the court have right to order the infringer to provide relevant information, such as accounting books, etc.  

    The amendment of trademark law is also to simplify the trademark registration procedure and maintain the fair market competition.
