On November 12, the State Intellectual Property Office ("SIPO") published Draft Regulations on Service Inventions (hereinafter as the Draft) and is seeking public comments.
There are a total of 7 chapters and 46 articles. The General Provisions under the Draft provides for supervisory administration, scope of application, definition of inventor. The remaining articles provide for ownership of IP rights from the inventions, report of inventions, application of IP rights, rewards and remuneration, utilization of IP rights from service inventions.
Service invention system is closely related to the enthusiasm for innovation by inventors and their entities. In order to encourage the innovation and inventors, Chinese government issued the 2010-2020 Guidelines for Mid-long term development regarding talent people, which led to the formulation of the draft regulations.
