    China and the United States agreed to strengthen enforcement against IP infringement

    According to the Notes on the Joint Achievements of Economic Dialogue under the Framework of the Fourth Round of U.S-China Strategic and Economic Dialogue (hereinafter referred to as the Notes), both China and the United States will further enhance enforcement in combating IP infringement and increase enforcement resources. China will further improve IP-related laws and regulations and study measures of criminal responsibility for IP violation.
    According to the Notes, China and the United States will be dedicated to strengthening IP border cooperation and protection, reducing the cross-border trade of IP infringing commodities, and strengthening the supervision and enforcement of intellectual property rights. Joint efforts will be made between the two sides to create a fair environment for respective market in order to improve the protection of IP-intensive products and promote the services and economic development. The United States appreciated China’s continuing efforts in installing and using of authorized software in governmental departments. It is leant that China has included software assets into governmental department asset management system, and will continue to promote the using of authorized software in Chinese enterprises.
    The two sides affirmed that trade secret protection is one of the important parts of IP protection and the two will curb the improper use of trade secret. China said that in the 2012 annual work plan of the National Leading Group for Combating IP Violation and the Manufacture and Distribution of Shoddy Commodities, enforcement actions against the improper use of trade secrets will be included.

    With regards to foreign trade and investment, the United States promises to take into consideration China’s request for fair treatment in reforming the export control system. Moreover, the United States commits to accept and review China’s request to purchase high technology for civilian use. China promises to create  a favorable market environment of equal competitiveness and shall treat all enterprises equal in credit assets, tax incentives and supervision policies regardless of ownership of enterprises.
