In order to collect from the public complaints and opinions on patent examination of the State Intellectual Property Office (hereinafter SIPO) and continuously improve the quality of patent examination, the SIPO officially launched the Patent Examination Complaint Platform, which was on trial use in July , 2011. The official website is: http://scywts.sipo.gov.cn/.
It is learned that the public may get access to the Complaint Platform via a registered user or anonymous user and submit any complaint relating to patent examination. SIPO will respond in a prescribed time limit.
According to the SIPO, complaints do not replace any response of official actions. Therefore they are not binding opinions from SIPO. In case the applicants are not satisfied with the SIPO decision or action, legal procedures should be initiated before the Patent Reexamination Board of the SIPO, or before the People’s Court.
It is known that by the end of 2011, a total of 113 complaints were received and attended to.
