Recently, the Opinions on further Crackdown on IP Infringement and Manufacture and Sale of Counterfeit and Inferior Goods (hereinafter refers to as the Opinions) was passed at an executive meeting under the State Council. It was agreed that a national office will be established to facilitate China's efforts to fight against IP infringement and manufacture and sale of counterfeit products. The office is under Ministry of Commerce of PRC.
At the meeting, importance was further strengthened to set up a long-term mechanism. The following measures are to be implemented: 1. Administrative enforcement should be further enhanced;2. Criminal actions should be further used against the IP infringement and manufacture and sale of counterfeit and inferior products; 3. Supervisory responsibilities should be clearly identified and each local government agency should take the full responsibilities of the local areas. 4. Punitive measures should be used for incredibility and illegal operations; 5. The role of the public monitoring should be well played and the report system should be further developed; 6. Laws, regulations and rules should be continuously revised or implemented against the IP infringement and manufacture and sale of inferior products; 7. International cooperation should also be strengthened and a bilateral cooperation mechanism should be established in order to learn the expertise and experience of other countries.
