No satisfied with the ruling by the Trademark Review and Adjudication Board (TRAB) under the State Administration for Industry and Commerce (SAIC) in which registration of ZARA as trademark was approved, the Spain-based Inditex Textile Company(hereinafter refers to as Inditex Co.) appealed to Beijing No.1 Intermediate People's Court. The court rejected the appeal in its decision.
Tan Yueqin earlier filed the registration of the opposed trademark ZARA in Class 6, Class 29, Class 32 and Class 45, covering goods and services of metal artwork and pork product, etc. TRAB affirmed the registration of the trademark ZARA The court held the registration of trademark ZARA did not damage the trade name of ZARA, and did not generate ill impact for public interest. Therefore the court made a decision in favor of the defendants.
