Upon the approval of the Supreme People’s Court, Beijing Haidian District People's Court was designated as the first instance court for cases of below 5 million RMB claim or between 5 million to 10 million RMB claim. The patent cases are limited to patents for utility models and designs only. In the future, the concerned parties do not have to file the first-instance case before Beijing No. 1 Intermediate People’s Court.
Below are 9 kinds of cases related to patent disputes including disputes over application of patent right, the ownership of patent right, the patent assignment, infringement of patent right, pass-off of patent right, the award and remuneration of the inventor of a service invention or a designer of a patent for design, pre-trial application for stopping infringement, and the preservation of property and evidence; the qualification of the inventor or designer, etc.
As a matter of fact, Haidian District People’s Court first started to set up a tribunal for IP in 1995 and has handled cases in a broad range including but limited to patent implementation and licensing contract, contract related to copyright, trademark, trade secret, trade name, internet domain name, etc.
