Recently, a shop in Wuxi of Jiangsu province was sued by Puma AG Rudolf Dassler Sport (hereinafter refers to as Puma AG) for trademark infringement of “Puma and device”. Eventually, the Puma AG settled with the case with the defendant before Wuxi's Binhu district court.
During the court review, Puma AG alleged it registered trademarks of “Puma”, “device of Puma”, and the combination of “Puma and device” in 1991 and use them in glasses of shoes, hats and others. They then found that shoes and socks bearing counterfeit Puma trademark were for sale in the shop in Wuxi in the early of 2011. Puma AG did a notarization and then filed lawsuit against the shop for trademark infringement, seeking for tens of thousands Renminbi yuan in damages and asked the defendant to make a public apology.
Upon review, the Court found that the defendant's act infringed Puma's trademark and would cause confusion among consumers. Upon mediation by the judge in the Wuxi Binhu district court, the two parties agreed to settle the case.
