Recently, the Supreme People's Court issued the 2010 White Paper on Judicial Protection of Intellectual Property. This is the second time the SPC inform the public of the statistics and development in IP protection.
According to the paper, the courts at all levels received a total of 42,931 cases and concluded 41,718 cases as first instance, and 66.76% were settled or withdrawn.
In terms of the administrative litigation for IP, 2,590 first-instance cases were received. 2391 cases were concluded. More cases are in the area of trademark.
With regard to the criminal protection, 3,992 and 3,942 cases were received as first instance criminal cases. 3492 cases were concluded. 6,000 people were proved guilty.
It is also learned that SPC is considering the drafting of judicial interpretation relating the judicial protection of copyright on the internet.
