In order to cope with the trend of increasing copyright disputes on the internet, Internet Society of China (hereinafter refers to as ISC) and intellectual property tribunal under the Supreme People's Court recently signed a memorandum of setting up a mediation mechanism for IP disputes over the internet.
According to the memo, where the relevant parties agree, IP disputes relating to copyright, trademark and other IPR infringement over the internet can be mediated by ISA upon the commission of the courts. Where any technical advisory opinion is to be provided, ISA can recommend the relevant technical experts.
According to the official from SPC, efforts are being made to mobilize the social resources to settle the IP disputes by way of reconciliation, mediation or litigation. The role of ISC should be fully utilized in order to provide the relevant parties with more choices in settling the disputes.
The memo also requires that SPC and ISC should enhance information exchange and carry out cooperation in training on copyright and internet technology knowledge.
