Dongguan Intermediate People's Court in Guangdong province recently concluded a software copyright dispute relating to Windows Operating System between Microsoft Corporation and Dynamic Internet Bar Network Communications Co., Ltd.(hereinafter refers to as Dynamic Internet Co.). The contesting parties finally settled the case and Dynamic Internet Co. agreed to pay 100,000 Renminbi yuan to Microsoft Company for legal cost. Dynamic Internet Co. also committed to purchase 700 sets of authorized Windows Operating System for computers in their chain bars and other affiliated companies.
The case was brought by Microsoft Corporation at the end of 2009 before Dongguan Intermediate People's Court. Microsoft Corporation alleged that Dynamic Internet Co., without their authorization, copied, installed and used Windows Operating System and Windows Server System. Such acts seriously violated Microsoft's copyright and related rights. Microsoft Corporation therefore asked for a total of 1.58 million Renminbi yuan in damages.
Before trial, the judges at Dongguan Intermediate People's Court made an investigation and coordinated with the local administrative agency for copyright and the leading association for internet bars. The court then called on both parties and discussed about the possibility of a settlement. Both parties then agreed not to pursue the case further and settled the case by an agreement. According to the agreement, Dynamic Internet Co. will not use any pirated software.
