Zhejiang Boke Electric Appliance Company(hereinafter refers to as Boke) filed a lawsuit before Beijing No.1 Intermediate Court against the Trademark Review and Adjudication Board (TRAB) under the State Administration of Industry and Commerce(SAIC), and asked for rejection of its decision relating to the registration of the 三洋飞鹿(pronounced as sanyang feilu) and its devices.
Before the court, Boke argued that Sanyo Electric Company (hereinafter Sanyo) registered its trademark 三洋（pronounced as sanyang）covering goods of refrigerators on November 15, 2002. However, the mark 三洋飞鹿 was approved for registration on August 21, 2001. Moreover, the trademark Sanyo(三洋) has never been used on refrigerator and freezer since its registration .
Sanyo alleged that it entered the Chinese market in the 1980s, and it showed to the court that the mark Sanyo 三洋 was already approved early in 1982.
