In order to further promote the implementation of Intellectual Property (IP) strategy, stimulate and support the commercialization of patented technologies and boost the right transfer and implementation of IP, Beijing Municipal Intellectual Property Office and Municipal Bureau of Finance jointly released "Promotion Measures on Patent Commercialization"(hereinafter refers to as Measures) to provide certain funding for the patent transfer and license.
According to the Measures, municipal financial department will set up a special fund for the commercialization of patent by transfer or license. Contract must be signed for the transfer or license. The Measures also provided detailed provisions related to the fund, application, reviews and terms,etc.
The Measures provide for two types of commercialization: patent transfer and patent license. Fund shall be only provided for the commercialization where the transfer or license is more than 5 million RMB, The maximum fund shall be 500,000 RMB. Where the assignee or licensee is an entity resided in Beijing, the maximum fund shall be doubled to 1 million RMB. The fund applies to each transfer or license of the patentee.
The Measures became effective on August 1, 2010 and applies only to those transfer or license effected after October 1, 2009.
