Recently, a workshop on the standard of determining patent infringement was held in Beijing. Judges from the Supreme People’s Court and courts across the country, lawyers, and patent attorneys attended the workshop and more than 100 opinions were proposed.
Last year, the Supreme People’s Court issued the judicial interpretation relating patent infringement in which some principles were raised such as the doctrine of equivalence, principle of contribution and indirect infringement, priority art defense, design infringement determination etc.
It is important to know in practice how to use these principles in the courts. It is also important know how the courts will use the experts, witnesses, expert jurors, or the evaluation institutes so that the new judicial interpretation can be fully applied.
