In order to promote the comprehensive implementation of National IPR Strategy in 2010 and continue the tasks for IP protection in 2010, the 28 member agencies met at the Ministerial Joint Meeting on National Intellectual Property Strategy and issued the 2010 Action Plan for IP Protection in China (hereinafter referred to as 2010 Action Plan).
2010 Action Plan lists 164 specific measures which cover 9 aspects, i.e. legal construction for IP, examination and registration, administrative enforcement, judicial protection, training and education, international cooperation, IP protection of the enterprises, services for rightholders.
Below are some detailed measures under the Plan:
1. revision and formulation of related IP laws and regulations such as the trademark law, Identification and Protection of Well-known Marks, Guideline for Trademark Review and Adjudication, Guidelines of Anti-Monopoly relating to Misuse of IP Rights, Regulations Regarding Customs Protection for IP, judicial interpretations related to IP;
2. reconstruction of the record system of the Customs for registering IP, improvement of the trademark examination and management, achievement of 1-year pending period for trademark examination, electronic examination and approval for patent, establishment of circuit examination and concentrated examination;
3. research on establishment of appellate court for IP cases, streamlining patent and trademark approval, selection of invited technical experts and related database for the court
4.regualting the regional coordination of administrative enforcement for trademark, encouragement of the social public’s involvement in the copyright protection, establishment of a communicative mechanism between the rightholders and related associations;
5. publication of Judicial Protection for IP in Chinese Courts,
6. further implementation of the mechanism in safeguarding the Chinese IP rights overseas, establishment of Service Station for Chinese Enterprises at the international exhibitions or shows.
